第一条 为了维护社会治安秩序，保障公共安全，保护公民、法人和其他组织的合法权益，规范和保障公安机关及其人民警察依法履行治安管理职责，根据宪法，制定本法。
实施扣押前应当报经公安机关负责人批准；因情况紧急或者物品价值不大，当场实施扣押的，人民警察应当及时向其所属公安机关负责人报告，并补办批准手续。公安机关负责人认为不应当扣押的，应当立即解除。当场实施扣押的，应当全程同步录音录像。
